Terms and Conditions

Rules

1. Winners will be those solutions, which in the opinion of the judges, best meet the criteria outlined for each of the two categories mentioned below:
   
   Best Public Sector Solution
   Eligible solutions are those built for organisations in the Public Sector including Local Government, Charities, Education, Health and Central Government.
   
   Best Private Sector Solution
   Eligible solutions are those built for commercial organisations whose objective is to make a profit.

2. Solutions entered are required to have been created in FileMaker Pro* and currently in use by a registered company, educational establishment, government body, or not-for-profit organisation and nominated by a FileMaker customer or FBA or TechNet member.
   *Entries must be created in FileMaker Pro 9 or higher.
   
   
3. Only entries submitted on the approved online entry form will be judged.
   
   
4. All entries must be received by 17:00hrs on Thursday 7th October 2010. This deadline may be extended at the organisers discretion.
   
   
5. Only residents of UK, Republic of Ireland, Republic of South Africa, Iceland, Spain or Portugal and who are aged 18 years or over are eligible to enter.
   
   
6. Entries must be submitted using the online entry form at www.filemaker.co.uk/cubeawards10/entry before 17:00hrs on Tuesday 7th October 2010.
   
   
7. The details on the form must include contact details, a description of the issue addressed and how this was resolved.
   
   
8. FileMaker, Inc. does not assume responsibility for phone, technical, network, computer, hardware or software failure of any kind, stolen, incomplete, garbled, or delayed internet/mail computer transmission, or lost, late, misdirected, damaged, illegible, stolen, incomplete, misaddressed entire or incorrectly transmitted entries. Entries will be disqualified if not complete with all the information requested.
   
   
9. No expenses incurred by entrants, including travel, accommodation, subsistence, presentation materials, hardware or software will be paid by FileMaker, Inc.
   
   

10. Some candidates may be invited to present their entries either in person or via webinar on 21st October 2010 at FileMaker International, 2 Furzeground Way, Stockley Park, Uxbridge, Middlesex, UB11 1BB. You will receive your invitation to present no later than Friday 15th October. If you have not been invited, this does not mean that you are not still in the running.
    
    Presentations will last no longer than one hour per entry and up to 3 people may attend. Representation can be drawn from designers, developers or users. The presentation format will allow time for a formal presentation of around 20 minutes, questions and discussions. There will be no pre-announced shortlisted candidates.

11. An affirmation of eligibility, Ownership of Submission, Liability/Publicity Release and Compliance Statement must be completed by all entrants to be eligible. A copy of this document will be supplied on submission of the solution.

Judging Criteria

Solutions will be judged on their interface, their functionality and how well they meet an organisation's need.

Judging

The judging panel is made up of any or all of the following:- a technology journalist, an independent FileMaker trainer, an independent FileMaker developer and a FileMaker-employed Sales Engineer. The final winners will be informed on or around Tuesday 16th November 2010 at The CubeAwards10 event.

The judges' decision is final.

The winner and runners up should allow 30 days for delivery of their prizes. By entering, the nominated party (a) agrees to the official rules and the decisions of the judges which shall be final in all respects; (b) consent to the winners' names and likenesses and any statements, quotes, testimonials provided by the winners to reprint, display, and exhibit the entry for advertising and publicity purposes without further compensation except where prohibited by law; (c) and release FileMaker International from any and all liability for any injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession or use of any prize.

Conditions

Submissions will not be returned.

Prizes

1 x Winners of Winners Prize: Wi-Fi + 3G 32GB iPad* (approximate retail value £599), The CubeAward10 Crystal (approximate retail value £65), Winners Logo and Certificate

2 x Category Prizes: The CubeAward10 Crystal (approximate retail value £65), Winners Logo and Certificate

2 x Runners Up Prizes: Runner Up Logo and Certificate

*Where possible and subject to availability the iPad provided will be a local market version.

Total approximate retail value of all the prizes combined is £730.

Verification of Ownership and Originality

FileMaker International reserves the right to verify the ownership and the originality of the submission before any prizes can be awarded. The judges reserve the right to select an alternative winner in the event that a selected winner's ownership rights and the originality of the work cannot be properly verified. Only entries whose originality and ownership have been verified may be used by FileMaker International in future advertising and/or promotional materials. Failure to submit an affirmation of eligibility, Ownership of Submission, Liability/Publicity Release and Compliance Statement will result in disqualification from the competition.

Exclusions and Disclaimers

Employees of Apple Inc, its affiliates, subsidiaries, advertising and promotional agencies, or other identifiable ineligibles are excluded from this award. Winners are responsible for payment of all applicable taxes. FileMaker International is not responsible for lost, late, stolen, damaged, misdirected entries. Entries will be disqualified if incorrectly filled out, not complete, torn or tampered with in any way. For a copy of these rules or any questions contact:
